I have the honour to acknowledge Your Excel-

-lency's letter of the 3rd. instant on the subject of the pro- -section of Kwong King and two others under Ordinance No. 15

of 1907.

I much regret that so very erroneous report

of my surming-up should have reached Your Excellency. Far from saying that I thought the words used were not such as to warrant a conviction under the Ordinance, I summed up, as we say "dead against the prisoner". It was of course argued by Mr. Potter that "kill" used in the poem was only hyperbole, and did not really mean "actually kill". But I reminded the jury of the murder of Thomas á Becket, who was actually killed on the strength of doubtful words: of the pamphlet "Killing no Murder", when "kill" meant "actually kill*: and, further, I impressed the jury with the fact that though to English people the words might not be taken so seriously, yet to the Chinese the word meant what it said, and that it must be looked on as an in- -centive to slaughter.

Unfortunately there is no record of my summing up. On such occasions, one makes a few notes and then speaks "as the spirit gives one utterance"; so I can do no more than give Your Excellency some idea of the drift of what I said, as above, and as indicated in my previous letter.

With regard to the Ordinance however I had

noted one criticism to be forwarded in due course. It is of

course based an Article 75 of the China Order in Council of

1904, but there is a variance in the words which I cannot account for. The offence by the Order in Council is "exciting enmity" between the Government of China and its subjects, but
